Terms of Service

1. Acceptance of these terms

By accessing or using FreeBookConvert ("the Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. These terms form a binding agreement between you and the operator of the Service, Andrew Nakas, an independent developer based in the United States ("we", "us", "our").

2. Description of the Service

FreeBookConvert provides free file-conversion tools that run entirely inside your web browser. Files you process through the Service are not transmitted to our servers; all processing occurs locally on your device using open-source JavaScript and WebAssembly libraries loaded from public content delivery networks. The Service also publishes informational guides about file formats, optical character recognition, and related topics.

3. The Service is provided "as is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defect will be corrected. You use the Service at your own risk.

4. Acceptable use

You agree to use the Service only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. You may not use the Service to:

• Convert files you do not have the legal right to process, including copyrighted material you do not own or have permission to convert.
• Circumvent technical protection measures (DRM) on copyrighted works. The Service does not attempt to remove DRM, and you may not use it as part of any workflow that does.
• Convert or distribute material that is obscene, defamatory, harassing, threatening, or that infringes the rights of any third party.
• Attempt to interfere with the Service's operation, including by attempting to scrape, overload, or reverse-engineer protective measures.
• Use the Service in any way that violates applicable export control laws, sanctions regimes, or that would expose us to legal liability in any jurisdiction.

You are solely responsible for the files you convert through the Service and the use you make of the converted output. We have no ability to monitor or inspect your files, as they are not transmitted to us.

5. No warranty on conversion accuracy

File conversion is inherently imperfect. Formats encode different sets of information; round-tripping between them frequently loses fidelity. While we test our converters carefully, we do not guarantee that conversion results will be accurate, complete, faithful to the source, or fit for any particular purpose. Always verify converted files before relying on them. For irreplaceable documents, retain an unaltered copy of the original. We are not responsible for data loss, formatting errors, missing content, or any other defect in the conversion output.

6. Limitation of liability

To the maximum extent permitted by law, FreeBookConvert and its operators shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of the Service, including without limitation damages for loss of data, loss of business, business interruption, loss of profits, loss of goodwill, or any other commercial damages or losses, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation may not apply to you.

In any event, the aggregate liability of the operators of the Service to you for any claim arising out of or relating to these terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred United States dollars. The Service is free; this amount is zero in nearly all cases.

7. Indemnification

You agree to indemnify, defend, and hold harmless the operators of the Service from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of or related to (a) your use of the Service, (b) your violation of these terms, or (c) your violation of any third-party right, including any intellectual property, privacy, or contract right.

8. Third-party libraries and content delivery networks

The Service loads open-source JavaScript libraries from public content delivery networks (jsDelivr, unpkg, cdnjs). Use of these CDNs is governed by their own terms and privacy policies. We pin specific library versions and apply Subresource Integrity hashes to reduce the risk of tampered code being substituted. We are not responsible for the availability, security, or behavior of third-party CDNs or libraries, though we monitor for known vulnerabilities and update versions accordingly.

9. Advertising

The Service is supported by display advertising served primarily by Google AdSense, and may in the future include other certified advertising networks. Advertisements are subject to their respective publishers' policies and to Google's advertising policies. We do not endorse the products or services advertised. We do not control the content of individual ads. If you encounter an ad that appears to violate Google's policies (misleading, malicious, or inappropriate), please report it through the small "info" icon on the ad itself and let us know through the Contact page.

10. Intellectual property

The Service's name, design, page text, and original content are the property of the operator. The open-source libraries used to perform conversions are owned by their respective authors and used under their original licenses (typically MIT, Apache 2.0, or BSD). Nothing in these terms transfers ownership of those libraries to us or to you. You retain all rights to the files you convert through the Service.

11. Privacy

Your privacy is described in detail in the Privacy Policy, which is incorporated into these terms by reference. The short version: we do not receive the files you convert; we use Google Analytics and Google AdSense, both of which you can opt out of.

12. DMCA and copyright

The Service does not host user-uploaded content. If you nonetheless believe content displayed on the Service infringes your copyright, you may submit a notice meeting the requirements of the United States Digital Millennium Copyright Act (17 U.S.C. § 512(c)) to contact@freebookconvert.com. The full requirements are described on the Contact page. Misrepresentations in a DMCA notice may subject you to liability under 17 U.S.C. § 512(f).

13. Termination

We reserve the right to suspend or terminate access to the Service, or any feature of it, at any time, with or without cause and with or without notice. Sections that by their nature should survive termination (limitation of liability, indemnification, intellectual property, governing law) will survive.

14. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be noted at the top of this page for at least 30 days. Continued use of the Service after a change constitutes acceptance of the revised terms.

15. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of the United States and, to the extent not preempted by federal law, the laws of the state in which the operator resides, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the Service shall be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to the personal jurisdiction of those courts.

16. Severability

If any provision of these terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect.

17. Entire agreement

These terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements relating to the same subject matter.
